the primary job description is #1 make sure you swipe your badge, #2 don't put any files on a memory stick, 3) attend team pot lucks and volunteer events and show your face - no badge swiping required, 4) complete your training ahead of schedule and 5) ...I can't remember what the others are. Maybe that's it... o yeah...)6 is make sure you spend your Dell $ on Dell cafe cr-ppy food.

Even at will states have unlawful termination protection. If an employer terminates you for not being compliant with five days a week in office and you do comply and have proof, you’ve got a case. Period. At will doesn’t mean they can walk the floor and say your fired and your fired etc…

WRONG. in the US at least most states including MA and TX are “at will” employment. They can fire you, at will, without cause. They have no obligation to you at all.

Well, if you spoke to people all five days, you’ve got witnesses to prove you were there. They need to be careful about unlawful termination. If measuring by swipes, legally it’s on them to ensure the system is working. If you can prove you were there and they can you, you’ve got a reason and proof to counter sue. Generally, doesn’t bode well when the labor department’s (state level) gets wind of it and next thing you know, the state is in your building monitoring and opening your books. Checking safety and basic human necessities. They do come unannounced. How do I know? Saw it happen once. It was ugly for the employer and cost them millions in pay outs, fines, attorneys and rehiring. We do have rights.

My manager said only three of my five badge swipes showed up on the reporting. So I can get canned for not complying? You can’t make this sh-t up.

It’s not our job to make sure facilities is doing theirs. Period. We have enough to do besides reporting badge readers, no TP, cubes with no power and equipment that doesn’t work. Over and over again.
