RTO Ireland Contract Laws

Hired on a remote contract in Ireland and once the RTO was announced I was under the impression that those of us who were remote would recieve a new proposed contract and an option to decline as that is the law. Since that didn't happen and I was automatically switched to onsite I spoke to my solicitor who suggested to raise a grievence or just speak to HR first.

Just wondering has anyone in Ireland spoken to HR about this yet and were you successful in going back to remote classification?

You know nothing!

It states this because every employee has the right to request remote working. The law isnt worth the paper its written on as all the employer has to do is prove that they followed proper process in evaluating your request.

There is a very little faq link at the bottom of the main announcement page, there you find additional information about UK, Ireland, Thailand and some other countries. It clearly states you can apply for remote in Ireland!

fix your CV, be ready but at same time ask solicitor for advice.

If you don't want to go to office, don't do it if your contract is truly remote with your home as work address. Ask Solicitor tomorrow.

Ireland is a Phase 1 country so I suspect that Irish law is not as strong in this regard as other European countries

I am remote too but in phase 2.

In the addendum to Connected Workplace 2.0, it says that "the company has the right to cancel remote work at any point, without any reason" (free translation). Dell incorporated sentences like that in work contract/addendum/internal regulations/etc. However, they are not in line with (most/all?) local European laws. Therefore, they are null and have no legal or binding force.

You signed a contract to work from home and it cannot be changed unilaterally by the employer. It's the same as your salary. It's the basic elements of the work contract. If you salary increases due to a bonus, you need to sign an addendum. If they want to decrease your salary for no reason, you need to sign an addendum too. If the company moves, you need to sign an addendum too. Also, if you are not at your official workplace (your home) and work inspection comes, you can get in trouble.

I'd advise you to search Irish local laws or ask any local HR/lawyer friend from another company to get their opinion on this. But I'm pretty sure it's like that for European phase 2 countries, otherwise we would be in phase 1.

I also received a supplimental terms of employment which states that my work location is my home.

I have not had any document to sign which rescinds or changes these terms. I am therefore obligated to comply and work from home until i receive correct notice of any change. I do not consider an vague intranet page along with random emails which contradict the intranet page as correct or direct notice.

I was told you might win the case but you will more than likely be selected in the next WFR.

HR don't really seem to be taking responsibility on this and leaving it to management. However management don't know how to handle the legal questions.

I am angry we never got correct notifications, reasoning and 4 week notice for ending remote as per the wrc remote guidelines.

Boycott Tell Dell.

Document everything.

Raise a grievance with HR.

Hire a lawyer for legal recourse.

I would guess that there will be a paragraph around "business need" which may require you to attend the office.

I opted into be remote and received a terms of employment amendment. This had two different sections which gave them the ability to change my work location. Something along the lines of "if the nature of your duties change substantially" and another was that it could be "withdrawn where buisiness needs change"

but hey. You dont ask you dont get. Take your shot and if you are successful let us all know here and may the floodgates open
