Thread regarding UnitedHealth Group Inc. layoffs

Buyouts allowing them to avoid WARN act requirements?

Does offering these buyouts negate them from having to follow any of the rules / requirements under the WARN acts (federal and state) for large scale layoffs? Are they hoping they will get enough volunteers so that any layoffs they have to do (to meet cost saving promises they made) will be under the threshold of the WARN acts.

UHG will try to fall under the threshold for each state. But they’ll just keep doing it until they hit their targets. Sadly the targets are reset every quarter.

The WARN law is state specific. We are scattered all over the US and they know EXACTLY how many ppl in each state they’ve given notice to avoiding having to inform the Dept of Workforce. This happens every year, minus the VRSP. This also keeps their unemployment tax (SUTA) from going up hence this new approach. It’s all about THEM and the bottom line and furthermore staying off the media radar.

Something to remember if you look for a warn act notice, look at MN’s site. I’ve been looking monthly and have not seen one. Also, they only update the list monthly. So if they were to file, I’d think it’ll need to be up veryyyyy soon.

It falls under the company's home state if you're a remote employee. If we go by the 5/1 term date for the VRSP, then 4/17 would be the notification date for an involuntary layoff. That's about 60 days.

This is my concern! Is what we heard on Monday our 60 day notice? Or would I need to receive a letter with my name on it saying I'm being laid off, and then the clock starts? The state I live in requires 90 days notice for layoff. I'm also wondering if that applies, or does it fall under the company's home base state MN, which is 60 days.
