Japanese business culture should be modeled. The senior leaders should be taking responsibility when things go wrong. Their pay should be docked to compensate the victims. They should publicly apologize and personally take responsibility for the harm done to the customer.
Optics matter. Those corporate emails saying yes we know its a problem but settling potential lawsuits will be cheaper than fixing the issue inflame jurors and the public.
This seems pretty simple to me. Did Ford meet all government safety standards for the vehicle at the time it was sold. If yes, this should be overturned. If no, then Ford should be paying as well as recalling the vehicles.
I'm not going to say that quality hasn't been a concern, however go lookup the details of the crash that this lawsuit originates from. It's quite possible that if the truck hadn't been modified (lifted and big oversized tires) put on it that it wouldn't have gone into the ditch and overturn after flying nearly 100 feet in the first place.
It should. Ford had been building cr-p that ki-ls people for 25 years. All in the name of cutting costs and maximizing profits.
Even if it's reduced on appeal it's still worth it to shake down the company for a cool $20-30 million.
That award will be held up in appeals for decades
