Q: Can Dish Network lay off employees without a WARN notice?
I was a full-time hourly employee at Dish Network, which has thousands of employees, and was laid off in April without any prior communication. I am aware that 17% of the company was laid off at the same time. Can they do this without filing a WARN notice?

A: Under both federal WARN (Worker Adjustment and Retraining Notification) and California’s Mini-WARN, an employer with 1,000+ employees (including you) must generally give 60 days’ advance notice before a plant closing or mass layoff affecting 50 or more employees at a single site. Dish’s 17% workforce reduction likely triggers those thresholds at many locations, so a WARN notice was ordinarily required.
However, WARN allows an exception for “unforeseeable business circumstances” (e.g., sudden revenue losses or orders cancellations), which Dish may have invoked to excuse advance notice. California’s version also permits shortened notice if the layoff results from “natural disaster” or “business circumstances that were not reasonably foreseeable.”
If you believe Dish improperly failed to issue notice, you can file a written complaint with the California Employment Development Department’s WARN Unit or bring a civil action in state court. You’d seek back pay and benefits for each day of notice not given (up to 60 days), and you can recover attorneys’ fees if you win. Acting promptly—within the shorter of 2 years (federal) or 3 years (California) from the layoff date—will preserve your right to relief.

I got laid off right in the middle of a bad situation too. Right after they were really pushing people to go onto the boost network plan conquencuedently. I bet they hope no one files an annoumous report against them.

Basically Dish will pay to the end of the month and then have you sign an agreement saying you will not file for unemployment so you can get another three weeks of pay.
Dish has been running Boost into the ground since it acquired it. All the employees are like ticks draining a dying cow. I’ve never seen more complacency or lack of affect. The internal teams don’t even communicate with each other and everything is run in inefficient silos. The WFM policies are inconsistent and unfair across teams. You’re lucky to even get cost of living increases of 2% annually if you’re a top performer. The bias and nepotism there is insane. It’s truly the worst company to work at.
Dish doesn’t post layoffs on the warn site. I was laid off in 2023 without notice or severance. I was given a “dealing with your layoff” pamphlet and offered COBRA. I worked there almost 5 years. Don’t expect much from this sh*tty company!
EchoStar/Dish is going nowhere but downhill from here.
The unethical owner, cutthroat management and toxic company culture make it legitimately amongst THE WORST companies to work at!

What if employees do not get the phone service?
Technically, they give 60 days notice (if they are above the warn threshold), but it's treated more like severance - they notify the people who are being laid off, shut off their email, escort them out of the building immediately, but they are kept on payroll (and health insurance) for 60 days. This is actually fairly common for large companies to do; in lieu of announcing layoffs 60 days in advance.
How is it a notice if it's sent the day of? I thought a notice was supposed to be sent in ahead of time.
Dish has historical sent their WARN notice the day of layoffs. Don't expect anything in advance.

There would be a warn notice if many employees are affected at a company.

So Boost Mobile is done? I thought that was the big Dish business that was going to reinvent the company.
