Thread regarding Fiserv Inc. layoffs

9 hours + Offhour Prod support(Unpaid)

This is the new ask in BH,NJ.
Is this even legal guys?
This support used to be voluntary(Often pushed) but paid .
This offhour support will usually be in middle of night.
Some 3rd party organization need to take a look into the employment practises here.

@1f0+1jh30d7dg to be fair, salaried employees are not all exempt. You can be salaried and still be overtime eligible.

Specifically, it's "skilled" and/or "highly paid" labor that can be determined to be overtime exempt. For example, if you work in a computer company as a secretary, you're likely still overtime elegible.
If you work there in a computer profession, but earn too little you may also be overtime elgible. If you are an engineer making $200k/yr, you're probably exempt.

Many people have suffered pay theft by assuming that if they're salaried then they're overtime exempt. Please check with the US DOL to determine if you're truly overtime exempt.

Overtime pay is only required for hourly workers - not those on salary.

Don't install anything you are not comfortable with on your personal phone. They can't make you!

Guys,UNPAID hours greater than 40 hours is ILLEGAL.

My department says we need to have outlook and teams on our personal cell phone and we need to check it for messages and are expectwd to answer amy time of day. Is this legal? I read that it may and may not be legal to expect employees to use thier personal cellphones for work.

If they want me available outside my required, inflexible office time... too bad. I used to work split days to accommodate clients in Pacific time later in the day. Not any more. Sorry, Frankie says clients only care if I'm at my desk in a building for 8-9 hours so that's what they're gonna get.

Better solution. Don't install or use outlook or teams on your personal device. That is how I roll.

If you have teams or outlook on your phone turn off all notifications.

Check when you want to. I’ve done it and it is glorious to not be constantly bombarded.

If that feels too drastic at least turn off the notifications off hours.

This is why you don’t participate in bring your own device and turn off your work phone when you leave the office. If they don’t believe in real flexibility than work stays at work.

The flip flop of this is if you actually leave a little early or come in a little late, you take a hit on the badge swipe report. So much for balancing out….i’m not sure this is legal. Badge swipes used as time cards

Is it legal? Yes, it is.
Will it make for motivated, engaged work force? No, it won't.
Will it make people quit so you can jack up the stock price and retire a billionaire? Yes it will.

That's been expected since 2007, the last year I recall any on call pay for salaried workers. The problem is now there are not resources available to rotate off hours or weekends.

And yes as it has been said many times many ways its legal, for gosh sake google it GEN-Z.
