Assuming the deal closes in November and layoff starts immediately after the deal closes, when does the 60 day notice happen in order for VMWware to abide by the CA labor law? Do people get the notice 60 days prior to the November closing date? or there are still 2 months to go for people to look for job? tahsnk

Assuming you get WARN notice on day 1 of the closing, does Broadcom still make you go in for those 60 days? How does this square with the 2 weeks per year of service that keeps getting thrown around?

WARN protects employees, their families, and communities by requiring employers to give a 60-day notice to the affected employees and both state and local representatives before a plant closing or mass layoff.

The WARN notice ‘clock’ will start on the notification date (assume the day the deal officially closes). Once they inform you that your position is being let go, the clock will begin. Some states don’t have WARN notice and others do. Some states have 60 days notice, and others have 90 days notice. While on WARN pay, you will receive regular health benefits. Depending on how your severance plan is written, they legally can deduct the WARN pay from the severance payment, although they did not do this at CA, because our Severance Plan did not allow for deduction of WARN pay. Some companies do this. Rest assured, Broadcom will follow the letter of the law, but they won’t be overly generous if they don’t need to be.
The deal will probably take one year to close, with all the regulatory approvals, so probably Q2 2023. If you are in engineering, get ready for a nice long vacation for rest of 2022, work from anywhere, and you have lots of time to look for a new job. If you are in sales, sell all you can now to customers, so as to capture your commissions, because no customer will want to negotiate with Broadcom, they notoriously raise prices all the time. Then once you've captured your commissions, quit VMware for another hot company that values sales people, Broadcom will likely fire you, they don't care about sales people.
Good question. My guess is AFTER the deal closes. Officially, Broadcom cannot provide the notice before the close date.
