Repayment of VMware Sign-On Bonus

OK, here is the question - the job offer is explicit that the sign-on bonus is only earned if one stays with the company for a year. THere is also another statement saying that if one voluntarily leaves before the one year anneversary, then the unearned portion is repayable. The emphasis here is on "unearned"

Now, based on what's written above we can concude the following

  • the bonus is NOT repayable in a case of a layoff (emphasis on voluntarily)
  • the bonus is NOT is repayable if one leaves voluntarily, but it is prorated (emphasis on the word unearned)

What are your thoughts? Am I understanding this correctly?

How is prorated amount calculated? For example if $10000.00 was recevied and the employee worked for 10 months, how much would be the return amount?

If you are laid off, you don't pay back anything, its as simple as that. If you leave voluntarily you pay back per the ratio...
