Man, I can't believe the OP works at VMware. Things are going downhill if this is the type of id--ts we are hiring. Shut, get the shot, keep your job. Easy.

HIPAA (or HIPPA :-)) does not govern employers. However, the employer may not have access to any medical information (from your physician for example) without the employee consent.

If the employer requested an employee medical information from a healthcare provide (your doctor or dentist for example) and received it (without your consent, then the healthcare provider is in violation of HIPAA.

Once the employee consent to share "certain" medical information with the employers, it is not governed by HIPAA anymore. However, it is governed legally by "Ligitimate Need-to-Know Circumstances."

Fo-e example, if your manager does not need to know for the employer to make a decision related to your employment, then sharing your medical information with your manager is a violation of your privacy.

Sharing medical reason (with the direct manager at VMWARE) on why an employee may not (or does not want) get vaccinated is certainly a violation of the employee privacy.

There are two levels of laws here. One is federal and one is state of California. I can see several law will be violated should this happen to any employee.

Direct managers (especially software developers, business, marketing,... etc) have no reason to have access to medical information of their direct reports. None. whatsoever.

Should this happen, an employee should immediately file with full details of the disclosure with EEOC within 180 days of the violation.

Believe it or not, the manager and the person shared that information, both will be fired immediately. This is a huge business risk.

Given what we have been hearing of first line managers at VMWARE, it will be really stupid if this information is widely shared with managers in any form.

But you should at least report to ETICA and express your concern about your manager (the Psycho :-) anonymously).

nice try, but HIPAA does not apply to employers. It applies only in the healthcare setting.

The Rule requires appropriate safeguards to protect the privacy of personal health information, and sets limits and conditions on the uses and disclosures that may be made of such information without patient authorization. The Rule also gives patients rights over their health information, including rights to examine and obtain a copy of their health records, and to request corrections.
