Altice asking for those who are unvaccinated to test and upload results on personal time. Under the DOL’s guidance, the issue really is whether “the testing is necessary for them to perform their jobs safely and effectively during the pandemic.” For those in direct contact with the public, it would seem that they meet that standard, meaning that they should be paid for the time.
