Funny all the court attention over investor money and not a single indictment for any of the deaths caused by intentional deception by any of the managers or engineers that chose their paychecks over human life. Calhoun still espousing the fault being on the shoulders of less intelligent foreign pilots. Maybe the best for citizens safety would be a permanent closure…

Do the Boeing directors bear any responsibility for these losses?
The question before the Court in this derivative litigation was whether the
Plaintiff stockholders—New York and Colorado public pension funds—
had adequately alleged, under In re Caremark International Inc.
Derivative Litigation and Marchand v. Barnhill, that, as a result of the directors’
“complete failure to establish a reporting system for airplane safety,” or
“their turning a blind eye to a red flag representing airplane safety problems,”
the Boeing board faced a “substantial likelihood of liability for Boeing’s losses.”
In a 103-page opinion, the Court concluded that the answer was YES!!!

Attorneys for Boeing CEO and current and former directors asked a Delaware
judge to reconsider her ruling siding with plaintiffs

Boeing’s David L. Calhoun and other current and former directors are asking a
Delaware judge to clarify a legal opinion indicating she had found that Boeing’s
Board of Directors “publicly lied” about its handling of the 737 MAX.

In a motion for clarification filed late last week, defense lawyers for Mr. L. Calhoun
and the directors say the judge’s Sept. 7 ruling “contains categorical statements that
the Board and Mr. L. Calhoun misled the public about the board’s safety oversight.”

Vice Chancellor Morgan Zurn ruled Boeing stockholders may pursue claims
against the Boeing Board,
While Boeing said late Tuesday it was "disappointed in the court's decision
in allowing the plaintiffs to hold the Boeing Board of Directors accountable.

The court’s opinion cited comments by Dave Calhoun,
Then lead Boeing director, who became Boeing chief executive in
January 2020 after the board ousted CEO Dennis Muilenburg.

It cited Calhoun's comments that "the board had been 'notified immediately,
as a board broadly,' after the Lion Air crash and met 'very,
very quickly' thereafter."

It added that after the second crash of an Ethiopian Airlines 737 MAX in
March 2019, Calhoun represented that the board met within 24 hours of
the cгash to discuss potentially grounding the 737 MAX.
