I'm not sure it's legal but UP usually marks them with a white hard hat. These are usually the people with no thoughts of their own and are known for doing their best work on their knees.

I've always tried talking to them first, and that seems to work. If they sound stupid, then there's a very strong chance they are. I agree completely with the post about the management. If they got promoted to a management position, then they're probably too stupid to do actual ground work. If you need clarification on that, then look at all the good ideas coming out of Omaha.
If they get promoted to management, I think that's a pretty good sign of a learning disability.
Union Pacific is rife with a dunning-krueger virus. It spreads when incompetent sycophants possessing nothing else than a Machiavellian personality disorder get promoted thru endless pencil whipping of FRA rules violations. Once these narcissistic sociopathic liars are in position to appoint others beneath them they instinctually recruit others to place directly beneath them who will brown nose them and lie for them. They find others more dishonest themselves BUT also less intelligent then themselves so the lies will continue to cook the books but when any of this surfaces (derailment) the manager points to their little wing man and he takes the fall. Until all employees are allowed to report the truth without being told to get the job done without costing anything, the lies and toxic work environment will continue.
If they had another job offer but chose Union Pacific.
Not legally, unless you know how to assess this for yourself and are able to do so just based on what you see and know of them. It's not like it would do you any good to know. If it would help you be more helpful and understanding of them, if they do... then just imagine that they do and act accordingly.
