Qualcomm sued me for copying testplans

I have joined Qualcomm in last week of June and resigned on July last week as I got into tier-1 company. On my last day i have copied some of the testplans and SoC Block diagram. The very next day i got a call form HR asking me for explanation about copying their sensitive files. i have confessed about copying files accidentally and deleted in front of them(i have shared my personal computer via teams). I have joined my new employer 1 week later and everything going good. After 2 weeks i have received legal notices from Qualcomm attorney(Federal District Court, San Diego) regarding theft of sensitive information. Now i hired an attorney in San Diego to defend myself. The case is being in very initial stage. Can someone throw me some light if you know outcome of these kind of cases?(I am on H1B)

What the heck were you doing copying test plans on your last day? I don’t see what conclusion an employer or a jury could draw from this other than intended theft. If your story is real, I would be surprised if your new employer does not terminate you with cause for this behavior.

You’ll be heading home, possibly after spending some time in jail, and being given a hefty fine. The fact that you were employed for only a month could be used to prove intent. Saying you “didn’t know” won’t fly as a defense. You clearly downloaded the files for a reason. And once you are found guilty of this felony, you won’t be employable. No one is going to hire someone who stokes IP from a previous employer.

Have you been officially charged? It could just be a scare tactic from QC.

Per California law - The Act prohibits the theft of a trade secret by a person intending or knowing that the offense will injure a trade secret owner.

Therefore, key here is "intent" and "knowing." Probably your best defense is that the file was copied by accident with no intent of ill-will. Only your lawyer can give you the best advice.

Also, be prepared to lose your current job (if you get charged) because now you may be a liability to your current company, Ex. any project you participate in may get your current employer sued if it happens to look too similar to a QC model. But that would be the least of your worries now. You just need to defend your reputation if QC files charges against you.
