Thread regarding Sears layoffs

Get out now. Corporate has taken ALL your vacation away. Policy was changed when the minimum wage underlings were called back from furlough. Vacation is counted as time worked again. You can't take it over 40 hours. So not only will they not pay out vacation when you are terminated due to store closure, you won't be allowed to take it once you go into liquidation, and you can't just throw those vacation or personal days on your day off if you have worked 40 hours.

Of course corporate wouldn't tell us they were changing the policy before furlough, and they didn't even inform any associates after furlough. The only notice associates got was when it wasn't paid on their checks.

If they haven't announced your store closing, take every single hour of vacation you have earned right now... And all your personal days . I'm not kidding.. go in tomorrow morning and tell your store manager you are taking every hour right now.
If they tell you "no" tell them to call any manager at any closing store. Get what you earned. And then call your HR manager and ask them why you weren't given notice about losing your earn d benefits.

Sorry guys. I meant to say that in California Sears and Kmart have to pay out all unused vacation hours if the store closes or you leave. Sears had to pay out my unused 155 vacation hours when our Sears store closed.

Employees at my store use vacation hours. I know this because I do payroll. Perhaps it was earned from long ago, but I look up how much vacation hours employees have and use it when they submit a request for it.

No, that's illegal they can't and wouldn't be able to do this. Sears wouldn't do this to an employee anyways, you guys are so vicious against sears. No wonder there having such a hard time staying productive as far as revenue goes.

We were told this “new policy “ last year. When my store closed a few months ago the hr rep came in and let everyone know how many hours we had of vacation and the store manager made sure that we used it all before we were laid off. I am no fan of sears but you need to get a life and stop making up stuff.

@cji+16pVWHmm - It may not be legal but they do take vacation away. I had over 3 weeks accrued when they announced our store closing. During the 2 1/2 months we were in liquidation I took 3 full weeks + my personal days. During liquidation our payroll person would add vacation to any weeks I worked less than 40 hours, so I lost less than a day in the end.
