I have 10 official PTO unused. Was told it cannot be compensated in any kind.

Some states consider vacation and PTO (but not sick leave) to be accrued wages. Consequently, those states require payout of unused vacation and PTO at termination and have rules limiting use-it-or-lose-it policies. For example, an employee who resigns with three sick days and three vacation days would only have to be paid for the three vacation days. If the same employee resigned with six days of PTO remaining, they would need to be paid for all six.
In other words - if Dell refers to both sick time and vacation time as PTO and you live in a state that requires the accrued vacation or PTO hours to be paid out - Dell has to pay the PTO whether or not they call it sick time or vacation time. If the vacation time is not accrued then that has to be paid out. Only specific accrued “sick” time would not be paid out.
The specific states are: California, Illinois, Louisiana, Massachusetts, Montana, Nebraska, North Dakota, Arkansas, Colorado, Puerto Rico, Rhode Island. (But I do think you have to be with the company for 1 year.)
PTO is not accrued, vacation time is. PTO for DELL is sick time.
Just take PTO for the rest of the week and tell them to s— it.
Depends on what state you’re in. Check the state laws.Texas will not pay, Massachusetts - by law the company has to pay regardless of company policy.
I assume you are in Texas. They are hiding behind a state rule (or lack of rule). 24 states require companies to pay accrued vacation upon termination. Texas is not one of them. Michael, be a man and don’t hide behind this silly rule. At least pay the folks what they earned. Jeff Clarke on Monday said he will treat everyone with dignity. Is this what you call dignity? Stealing vacation days from fired employees ? Come on man. Tell your HR folks to fix it.
Your manager is correct.
Either they changed the rules, you have not earned them yet, or you are being lied. Hit up HR and ask for policy. Then take that to manager
