Has anyone had the packaged reviewed by a lawyer and believe a possible lawsuit can be opened or already in the process??

HR told me today I won’t get my severance pay because I didn’t sign /return the signed paperwork. We need lawyers
I didn’t sign the severance package but I want my money that is due to me. I don’t think GA will give me what’s due to me unless I obtain a lawyer. What is the attorney you are working with?
What attorney are you working with? I may contact them also. The severance package also indicates it must be signed & returned in order to receive your pension (1 week pay for every year worked). I think they are going to try to hold that money & not pay unemployment until it is signed & returned.
My Attorney advised me not to sign the package because i have a disability and there was a large number of people who were disabled that were laid off. So for those still thinking about signing the package i would highly recommend to seek advice from a labor law Attorney!!! I asked HR for my performance reviews and i got a call back from their manager a week later. This person asked me why i wanted my reviews and i told them i was seeking a new job and my yearly reviews are exceptional. She told me if i seek employment and i am hired before 10/27/2020, i will no longer be eligible for paychecks under the WARNS ACT. i spoke to my Attorney about what i was told.... and like the other post says. My Attorney told me there is no law in Cali that states that if you retain an new job, during the 60 day period the WARNS act is forfeited - I was told that in telling me this, it amounts to a threat and they can be legally liable.
Also, to the possible Jan 2021 layoffs that a few are talking about - here's something that my former supervisor told me before i drove off. "i know it s—s but you can also count yourself lucky" she smiled and patted me on my back and i left a company that i truly enjoyed working for with a mix of emotions thinking about why she told me that!!! -
I also got the same 2 months "paid administrative leave" as everyone else, plus a lump sum severance to be paid on or after 10/27/2020. The lump sum is based on my 6 years of employment. There was no room for negotiations on that severance. In my package, HR listed the titles and ages of the employees who were laid-off in my P&L group. The ages range from 30s to 60s, many mid and high level positions. I suspect they did that to avoid an age discrimination lawsuit. I don't foresee a case, but still waiting until the last minute to sign the paperwork.
I have already consulted an Labor law Atty and if enough take their complaints to an Atty there is a possibility of a class action due to the majority of the layoffs were over 40+, a protected class as well as people who had disabilities, work comp claims and were out on medical..Anyone who was a liability it seems. If they can prove that out of the 630 people laid off ( well you are not laid off, your job was terminated) that the percentage of the people were over 40+ and very little under that age then it could be processed as an age discrimination and ADA class action lawsuit. If you sign that package, you will lose those rights as well not be eligible to be rehired. So if you want to work at GA-ASI so you don’t lose any benefits, then apply for jobs on the GA side well before the last check has been paid. They are not laying off in GA and are hiring. They can’t keep you from applying as you still legally are with the company until 10/27 due to the WARNS ACT. It was also brought to my attention from a laid off worker that GA-ASI HR DEPT is telling laid off people they can’t get another job until after you have been paid your last check. Per my Atty they can’t tell you to not get a job and they are still legally responsible for paying up to the 10/27 whether u get a job before then or not.. there is no law in CA that says you can’t have 2 jobs.. very terrible advise they are giving and can cause more lawsuits!! So please before you sign anything consult a labor law Atty to make sure you are not signing any legal rights away.... GA-ASI is known to not do things ethically!!
Also next lay off is planned for Jan 2021 and is suppose to be even more people!! So tell all your friends if you have any still working there that they are on a sinking ship!!!
I'm definitely not signing that package i don't need the severances package. signing my life away for a few thousand bucks is just not worth it.
"same 2 months" ? the paperwork i received is based on length of service, 1 week of pay per year.
Has anyone tried to negotiate the “severance package” ? I called and they said it was non negotiable and everyone is getting the same 2 months.

Have the attorney but waiting. Wanted to see if I was the only one who felt there may be a case.
