Important Update For Furloughed Associates (extended to 09/30/20)

As we communicated on June 17, 2020, we anticipated the furlough to last at least through September 8, 2020. As COVID-19 continues to significantly impact our business operations, we are extending the furlough through at least September 30, 2020.

Please keep in mind that some associates may be called back to work sooner on an as-needed basis.

Furloughed associates will continue paying premiums at active associate rates for continued participation in medical, dental, vision, optional life insurance, long-term disability, accident and critical illness coverage.

As a reminder, you are eligible to take advantage of unemployment and other state and national relief programs where available while on furlough. In order to assist you in applying for benefits that may be available to you, please reference www.dol.gov or call 1-866-487-2365.

For additional information, please refer to the Updated 2020 Coronavirus Response Furlough Policy and FAQs, which are posted on MPI. The FAQs are updated as needed. Please send an email to the following with any additional questions: hradministration@transformco.com.

According to SHRM (Society for Human Resource Management):
"WARN Issues

Many employers did not have to provide notice under the Worker Adjustment and Retraining Notification (WARN) Act when they furloughed employees because they reasonably believed that the furloughs would last for only for a few months and not six months, which is the key trigger under the WARN Act.

Employers that are considering permanent layoffs now need to consider whether these "employment losses" will trigger any obligations under WARN. Generally speaking, an employer may have a duty to provide advance notice under WARN if 50 or more full-time employees will be laid off at a single site of employment in a 90-day rolling period.

Don't forget to consider state law as well. Even if employers do not have to provide notice under federal WARN, a number of states have lower thresholds in terms of the number of employment losses necessary to trigger notice and other requirements."

I cannot find anything about a federal or state law regarding the maximum length of a furlough. I've been on furlough from Hoffman since April 3rd.
Can anyone share a link showing the law?

"Federal law requires companies to provide a date of separation for furloughed employees who are not recalled within six months. October 5th is that date.
