Settlement for discrimination?

With the layoffs and all, if one forgoes the package and sues for discrimination, is the settlement like on Chevron's board, 5x of salary? Shell lawyers and HR seem as incompetent as ever ...

In Shell US, you have to go thru mediation first before filing a lawsuit (it’s little known by employees because it’s a short clause in your onboarding paperwork. You can still file an EEOC claim and keep your severance but that process takes time.
If you go thru mediation, you forgo your severance but rest easy. Get an employment lawyer — do not handle your mediation case alone because you will lose. Your attorney can push for your severance money + more depending on how strong your case is. You will recover your severance so don’t worry. At mediation, most parties reach agreement. If not, then the employee is free to file a lawsuit. Shell will settle because the process is cost-prohibitive...especially now. Their strategy now is to cut their losses. As a result, former employees with a claim have a good chance of winning.

Something random I learnt - Shell lawyers don't do litigation themselves, but hire an external firm instead.

Shell has deep pockets, but so what? If you give them no reason to counter-sue, it won't help.

Honestly envy those people in PDO (Oman). Locals (citizens) have a special quota and they cannot get laid off easily.

With all the Dutch expats running around if your a minority and got dismissed I would sue the ## out of them.

Just keep in mind, Shell has much bigger pockets than you, sooo if your young just move on, if your older just take the package and move on. The company is a shell of its former self (pardon the pun). Ben should be kicked out on his arse ...

I had a Dutch manager On one occasion in reference to a lady being referenced off he statewtated she wouldn't be in that situation if she hadn't gone on maternity leave. In reference to a female that got a GM position overtime stated it pays to have *it's.., discrimination is alive but winning in court......you potentially put that nice severance at risk

You could get 5x. or more likely you could get -1x after paying the lawyer.

I hate when people set they have been discriminated against. I have been in a room that afterwards a person says they were discriminated against. They complain about it say they are going to go to HR, bring up a lawsuit, etc, etc, etc. but the problem is what they think was discrimination is not they are just assigning it to discrimination so it someone else’s fault. Please take a step back and truly judge the situation before assigning blame elsewhere. There is nothing worse then the boy that cried wolf. Well look right there, now that’s racist it’s a boy, why not a herm or it be or homosexual or Child of a different race then I am. See assigning blame to the old book title does not proof discrimination. You want it to be discrimination so it’s not your fault be it’s not. They only people who want discrimination or even recognize discrimination are the people who want to use it to get something for nothing.

Talked to an employment lawyer about this... It’s a gamble considering you’re paying a lawyer his hourly wages hoping you’ll have some sort of leverage ... I wish I wore a wire for a few of the discriminatory comments... LOL... Ohh well. Can’t wait to get out of here! I’d leave for free with the blind leading the blind situation.
