Thread regarding Occidental Petroleum Corp. layoffs

I know our 401k is protected by federal laws. But is our Oxy pension protected too in a ch 11 or 7 bankruptcy? The answer to this will determine if I need to leave Oxy now or later. If anyone knows, or has already spoken to a labor/corporate lawyer, please educate us.

Really off topic but I agree it is their decision to report it. I also know of several harassed and too scared to lose job if reported. These @$$holes are still managers. Many other things go on too and HR hides it.

I agree with MTC. I've been a witness in situations where s-xual harassment issues were raised with HR, and nothing was done to the harassers. In fact, HR protected those individuals. Most often, the victims are afraid to do more than that (such as going to authorities or filing a suit), as they are very concerned about their careers. I have never seen HR supportive of the victims or the standard employees in these situations. They seem to do upper management's bidding, sweeping things under the rug.

@1pwi+15dnx8Ak Not involving me, but someone I know well. And whether they did or didn't, that's their decision and not mine. Reading this board, others have posted similar stories.

Why would I waste my time coming here and making stuff up? Especially about a subject like HR?

But hey, lets go ahead and deny it. How about we blame the victim next?

Had a pension, with Shell. Altura, Oxy...not a pension offered. Just a 401 and PRA.

I think that money is yours if you have met the Oxy vesting requirements. The money is in your Voya account and you can move it between investments. I am going to say it is yours and can’t be touched by Oxy.

The question should be why is this lazy employee coming on to lay-off website to get critical info about his retirement. The information has been distributed on multiple platforms for employees. The OXY cancer is laziness. Why can’t this person go ask HR or find the info? Why didn’t they attend the info sessions? Lazy. Typical oxymoron

Are you referring to the PRA/ retirement plan? If so, that's protected too as long as it is vested as it is yours.

The downside is if you are invested in Oxy stock in either the 401k or PRA, then that value is gone.

This is up to the negotiations. By itself, do not know pensions are protected (not a lawyer) however, from reviewing previous ch11 plan of reorganizations, have not seen an instance where this is not addressed under the plan. However, ch7 is liquidations. In that case, even if a valid recipient, would doubt that you would receive anything from a waterfall payout. In either case, all of this rests upon the priority of your claim/interest. Until the plan is filed, treatment is speculative.
