They'll deduct it from the severance check. You don't get to GIVE them anything.
They can only get back what you give back to them.
If you've used vacation days before you've earned then then yes, you are being paid for days that you are not working and will have to pay it back from your severance. Should've read the multiple emails about how this works.
Does this mean I have to pay back vacation if I get laid off? I am on days off and just waiting for that lay-off call. I used up my remaining vacation days for the year does this mean I have to pay it back if am laid off?
This change for 2020 was announced in a company wide email Oct or Nov last year.
That change was made starting Jan 1 I think. Vacation is prorated to the year, so if you have 4 weeks entitled, you "get" one per quarter. It's up to manager discretion if they "let" you use it "ahead of time", say using two weeks in the first half of the year.
