Partial Unemployment

Anyone know of partial unemployment laws in TX or CO? If OXY is wanting to reduce our pay, is there a chance of being eligible for partial unemployment? I do know some states you can qualify. Might be worth looking into.

Sounds like you work in HR or EC and thought we were too stupid to do the research and read between the lines that a 30% pay cut gets unemployment benefits.

None of that is lies and fear. It's all fact and directly from Texas Labor Law. Instead of spending "some time talking to the multiple people working for TWC", you'd better get that in writing.

Unemployment Benefits Fraud

Claimants and employers commit fraud when they knowingly provide false or misleading information, withhold information, or fail to disclose a material fact to obtain or increase benefits. Unemployment benefits fraud is punishable by law, both felony and misdemeanor, and violators could face fines and jail time.

Be aware that:

Failure to follow the rules can result in serious consequences.
Claimants and employers must respond truthfully and fully to all TWC inquiries.
In Texas, unemployment benefits fraud is routinely prosecuted at the felony level.

Fraud Penalties

The Texas Unemployment Compensation Act (TUCA) provides for administrative, civil action, and criminal penalties for fraudulent misrepresentation to obtain benefits as well as for recovery or recoupment of benefits that were improperly paid. It also provides penalties for fraudulent representation by an employer or any other person to prevent payment of benefits on legitimate claims or to reduce tax payments.

Penalties may include fines of up to $4,000 or imprisonment of up to one year or both, forfeiture of benefits received, and the right to benefits that remain in the claimant's benefit year. Claimants who commit unemployment fraud must pay back benefits they were not entitled to receive plus a 15 percent penalty on benefits they fraudulently received. TUCA is the legal basis for initiating a civil suit against a claimant for collection of past due benefit overpayments.

@qqgg+14Fv1GnJ you are wrong spent some time talking to the multiple people working for TWC and they have all said that you can qualify for partial unemployment benefits. Quit spreading lies and fear.

Total and Partial Unemployment

(e) For purposes of this subtitle, an individual is not considered unemployed and is not eligible to receive benefits for any benefit period during which the individual works the individuals customary full-time hours, regardless of the amount of wages the individual earns during the benefit period.

Looks like a reduction in wage doesn't qualify although many are claiming to be approved for partial unemployment and receiving (or waiting on) their checks from TWC. So doing some creative math and telling the TWC that your hours are 'essentially' reduced since your pay has been reduced might get you in big trouble should you collect. It may be just returning the money plus 15% and it could be jail. That would s—.

Actually probably LAPC since all they do is talk about COC. I know some that b–ch so much even after they came to work that Oxy let them go ahead and leave with the package. I am sure they are sitting at home right know collecting unemployment or waiting until they can. Typical APC troll to think you are better than others. Your silver spoon attitude is why Oxy people never welcomed you.

Some of the Anadarko people do nothing but complain. They want to blame OXY employees for all of their problems. OXY employees had no control of what Vicki Hollub and her counterparts did. We all have lost in this current situation.

Good question, but I would be surprised if you could. When you file with Texas Unemployment you have to tell them why you lost your job, and then they usually contact the employer to find out the reason. It can be declined for various reasons by the employee. Since you still have a job that might disqualify you as well. Plus, why would the government supplement a large companies salary base. I just don’t see it happening. But worth calling the unemployment office to see.
