Everyone's situation is different so some of this information is mis-guided. Don't worry about the impact of unemployment on your employer. It is either payed by them by insurance or it is self funded which means they set aside the money. So there is no "ADS saves money by you taking severance instead of unemployment".

Depending on your annual income, many will find that the max unemployment payout weekly is well below what they used to make. It is bare bones survival money.

Not sure if states have different rules, but when I went through something like this I got maybe 8 weeks of severance. My state would not accept my application for unemployment until those 8 weeks expired. Then you apply and wait. It took several more weeks before receiving funds. So there was a gap of no income.

I also had a sign to receive the $$ clause. But there was not a non-compete. I do believe my employer allowed for several days to allow me to think/review it with a lawyer kind of thing. Not sure if that is required. But what are you going to do? Take them to court? Think of the size of your bank account and your lawyers bank account. Then think bout the money your employer has and the legal department. They can afford to ride this out and cause you more pain and lost time. Not saying it is a lost cause or anything. Just that sometimes you need to close the door to that part of your life and get on with it.

If you still have a job then good. You have a chance to make changes now that can keep you going longer. Stop stressing bout being treated poorly or that the headcount cuts are unfair because of favoritism. Instead, focus on what you can control. You and your household. Look for ways to save money now. Put that money away for that rainy day. Cut cable. Spend $20 on an antenna at walmart. You need internet to search for jobs these days. So if you cannot afford both a cell and home internet, then use free wifi at libraries or coffee shops or steal it from your neighbors. Look around your home for c-ap you don't need and sell it on facebook or craigslist. Yea, this is a pain but what else are you going to do?

I know this from experience. Been layed off this way several times. Im nearing the end of my working years so it took a long time to find work in my field. Even though I was willing to take entry level work, employers don't want someone with a lifetime of specialty experience in a job that pays 30% of what they made last. In their mind, they think the worker will not be motivated to work or will not stay and jump at the first chance.

I'm not trying to be mean or scare anyone. I am trying to encourage you to get your house in order. There is an old saying; Dig your well before you are thirsty. It is so true. After my first layoff, my family made changes. Now, if it happens again I will be in a much better position.

Best of luck to all.

You can get unemployment once the severance ends. I was laid off before and received both.

Take unemployment!!! Versus severance!
For #1 you would get free health-care through the state. So forget their stupid insurance thats terrible healthcare
#2 you can file unemployment online it take less than 4 weeks.
#3 you take their non existent severance you cant sue them
#4 taking severance negates them from paying and REPORTING to office od unemployment. So the mass layoffa can go undetected.
#5 do not take their severance unless it equals out to what u could claim via unemployment

Remember unemployment does not equal severance and it does not come with health insurance. COBRA can cost upwards of $600-$800 a month dependent upon your situation and unemployment I believe is less than $300 a week in Ohio. Unemployment barely covers the benefits you are used to seeing. I am not recommending severance over unemployment, just make sure you are informed on what you and your family need and can afford.

It would make more sense to apply for unemployment, yes. You must consider the evil circumstance the company put them in.

  1. The fired them right during xmas season..not a good time to find a job.
  2. You get 60% of unemployment but you must wait, sometimes, weeks then you have to be qualified.

They did this during this time because they knew folks would see a lump sum versus taking their chances with unemployment.
So they worked them out of $ again!
That saves the company money again also makes their unemployment rates not being reporting accurately bcs some will dodge unemployment benefits all together, just take the lump sum and get ANOTHER job..
So even when they threw them out the door they still screwed them. No heart..
They sitring back laughing at the board like in trading places the movie. Its all a game to them.

wouldn't it make more sense to refuse to sign, and apply for unemployment?

12 weeks for how many years of service? October layoffs were 2 weeks for every year of service.

Correct, if you do not sign, you do not get severance.

So if you don’t sign it then you don’t get any severance?!?

Yeah, 12 weeks + benefits with an agreement to not sign at a "competitor" for 12 months.

Great way to ensure employees sign it so they get paid through holidays, and then have trouble finding work in an industry they have experience in.
