Question on Severance Package Dates

I received my severance package yesterday. My LDW is November 23. Signed severance agreement must be delivered by December 1. According to Section 5, paragraph (b), by signing agreement I acknowledge I have received all of my wages and expenses from the company. However, my last paycheck will not be until November 29, making it impossible to truthfully sign the agreement and have it arrive on time. ( In fact, according to section 20, I can sign agreement up to 10 days prior to LDW, which makes even less sense) Am I missing something here?

Also could be Nestle waiting for smoke to clear and no injuries or maybe lawsuits occur?

After we are done, they will gather info and crunch numbers. One reason why the bonus part will take longer. Your last pay check will be factored into your money.

It clearly states that if you sign before 10 days before your last day worked they have the right to not pay you. So by signing now and dating it for 10 days prior to LDW you would be in violation of that so I’m going to just do what it says to do.

u can sign it but date it and send ten days before your last day worked and our dsl suggested sending it certified mail, there will be a lag in severance packages almost guaranteed. the last person that had a buyout took him 2 months to start getting his monies. just like our pensions and 401 they dont send out info until jan for pensions. so if u want to roll it over u have to wait till the paperwork comes 2 months later. hopefully the going in waves thing will let hr catch up on everyones. payouts and bonuses. my last day worked is 11/16 i am not expexting a check till after x-mas which will be fine for tax purposes.

How can they pro rate you if ur last day of service is the 29th? There ur suppose to get the package after your last day worked .that way you have a total amount worked and pay amount what they owe you .

Does anyone on this site have an hr rep? Call them and ask, why ask an anonymous coworker from some part of the company for legal advice?
