Thread regarding Symantec Corp. layoffs

compliant offer vs comparable offer

Is a compliant offer whatever symc and broadcom decides they want it to be?
Or is there a broader legal definition. Based on the definition provided by broadcom as long the offer a job that is within 50 miles , benefits similar to broadcom, and total compensation equal to or better then prior to closing under the definition it is a complaint offer. Is this legal?

Does that mean if you are developer they can offer you a QA position as long as the total compensation is equal? If you are manager they can offer you an individual contributor position as long as the total compensation is equal or better?

Seems like a underhanded way to get employees to leave without having to pay out severance packages

Has anyone contacted an employment attorney to find out if given such an offer that can we decline the offer and receive a severance package instead?

The company doesn't want the expense and bad press from going to trial, and may settle to avoid it. Consult with a few employment lawyers.

Good luck. The reality is that even in states like CA, employment law is set to heavily favor the employer not the employee in these types of matters.

I did find this

The California Fair Employment and Housing Act (“FEHA”) states that it is unlawful to discriminate against “any person” over the age of 40 because of their age.

An employee older than 40 receives an unexpected demotion for no apparent reason.
