They can lay you off whenever they want here in the US. One guy off who was four weeks into his paternity leave in the Raleigh office couple years ago got hit. Called him up and forced him to come in from his leave that day just to get axed.

If you see the train coming maybe step off the tracks instead of hoping maybe, just maybe it won't hit me.
People are still at holidays.. by law in a lot of countries you can't kick out people when they are away on leave.
It is probably different in USA.
VP management will lay-off anyone at anytime so there is absolutely no loyalty to employees. Remember it is at will employment so anyone can leave without any notice.
