Qualcomm wraps up defense after expert rebuts FTC witness

The company called Aviv Nevo, a University of Pennsylvania economics and marketing professor, to rebut claims made by FTC experts.

Nevo testified that the FTC's theory that Qualcomm uses its power in the chip market to charge excessive royalty rates "is just not born out of actual market data." He noted "there's no support for the theory in the data." Nevo also testified that the mobile industry is strong and that Qualcomm had legitimate business reasons for its licensing policies.

Apple is surely one of rebellion. There are many names in the list. In 2017 Meizu was forced by Qualcomm to use its chip otherwise it will be bullied. That's not negotiation but bully. Fortunately, there is someone like Apple who is strong enough to say "enough is enough".

From the trial, the only people who felt the rates were unreasonable were Apple. When other companies felt the rates were high, they negotiated to a reasonable rate. Only Apple feels they are big enough to bully someone around. How much should Apple pay for a technology that distinguishes it from an iPod touch, a device 1/3 the price? You'd rather take a flip phone over an iPod for everyday use.

Many producers can make smartphones nowadays without Qualcomm's modems. Qualcomm makes more fortunes in the history than they deserved. But it's the time to change the crazy earning mode in the current scenario with much lower revenues in the industry than before. We are talking about the future not the past. Qualcomm must yield as all others must survive.

The problem with that statement is 1) the entire industry disagrees and 2) QTLs own slides show the Q fees are way way way more than anyone else charges. That is the very definition of 'unreasonable'.

But the FTC had yet more highly highly damaging facts including the documented history of Q refusing to arbitrate on a per-patent basis; Why so ? Well it was obvious in the trial, because amongst the 100,000+ patents, while there are many very valuable and genuine ones, clearly there is a ton of garbage that doesnt stand up to a challenge. Its embarrassing to be associated with Q these days.

And indeed, patents are now being challenged weekly and the sustain rate is get this ZERO ! Every single challenge in the last year has been upheld i.e. the patent found invalid. Whats that tell you about that big shiny patent wall downstairs ? It VERY SHINY. But dont look TOO CLOSE you might see the flaws.

Qcom rates are not unreasonable. Repeating this does not make it true. They charge Apple a fixed $7.50 per phone. This is for tech that makes an iPhone usable. Without a modem, you'd rather have a flip phone. The modem makes your flash valuable. They cap their fees at $13 for a $1000 phone. If they are capping it, they are not charging a percentage.

People inside or outside Q understand it's unreasonable to charge so high based upon price of a whole cellphone. It breaks out nowadays because industry revenues are shrinking and wireless communications enter a bottleneck. 5G is a fake requirement and improvement as every expert knows.

With incorrect statements, such as the following quote, i can only believe the company screwed up big time calling this witness.

"Prices are declining. Quantities are skyrocketing"

Common knowledge consumer retail phone prices are higher than ever, and the industry, including suppliers to manufacturers to carriers, are all forecasting a slowdown this year.

My only hope is the judge is dumb but not holding my breath
