Based on what you know so far, do you feel there was age discrimination during the selection of people who are being laid off? If yes, what makes you think so. I know only 4 people who were laid off, 2 are over 40 and 2 are over 50, not sure if this is a pattern but it does not look good, or should I say it does not feel OK. Thoughts.

@d4 , I agree with your statement. I know folks who were 1st VSPd interviewed for other positions in the same dept; and was told by leadership they weren't 'qualified." The individual that interviewed for the position was familiar with the position for over 5+ yrs. Also the individual is very tenured.
They are losing the most qualified folks for VSP/ISP.
Most of the layoffs, demotions, and pay cuts targeted employees over 40. Most were Women. A class action lawsuit in the making.
Age and gender discrimination were apparent with layoffs and demotions.
I absolutely loathe the executive leadership of this firm. I so wanted to be Team Penny, but no. Actions speak louder than all her “One Edward Jones” BS.
May the fleas of a thousand camels invest her underwear.
I don't think there's any age discrimination here - I know both 50s+ and 20s/30s who were ISP'd.
@be not all associates live in MO. Also, other employers have lost such age-related cases.
[Company] discriminated against older workers in layoffs, EEOC finds
The commission’s finding follows a five-year investigation triggered by employee complaints, which cited investigations by [newspaper] into [company's] layoff practices. “There is reasonable cause to believe that individuals over the age of forty were laid off or otherwise separated by Respondent in 2015 based on their age and in violation of the” Age Discrimination in Employment Act, the federal commission concluded.
MO is an At Will state. Unless you can directly prove it is discrimination you are sc--wed. They just have to give a reason that is not discriminatory.
The two people I know who got ISP‘s were both over age 50.
You are a row in an Excel spreadsheet at the end of the day. you get sorted by cost(pay, benefits, whatever) and then get tossed. Standard MBA stuff
Prior to EJ, I have been through layoffs at other firms. Companies have an army of lawyers that make sure the layoff group does not look like it age or any other type of discrimination. It’s the same with EJ. They are all lawyered up. We are wasting our time.
Google gave me this when i searched for it:
- Older workers (40+) are often targeted in layoffs due to higher salaries and benefits, though framed as cost cutting.
- Employers may use performance improvement plans (PIPs) or require severance agreements that waive age discrimination claims.
- US law requires companies to provide laid-off employees over 40 with a list of ages and positions affected.
- Proving age discrimination is difficult: EEOC cases rarely succeed and lawsuits are expensive.
- Many older workers struggle to find new jobs, leading some to retrain or change careers.
- Companies often mix younger and older layoffs to reduce legal risk, but ageism in layoffs is widely reported.
