With the flagrant abuse of the H1-B visa program, I wonder when it will be time for a class action lawsuit - against Fossil and Infosys? Apparently, there are "legal loopholes", but hell...We the People have the right and responsibility to rise up against abuse of american workers to turn a bigger profit.

Well that makes it sound like we should burn the place down. Just saying at some point someone has to make a case for the American worker. The rate at which jobs are being outsourced vs nearby companies (not many other nearby retailers btw) isn't exactly even. The reason companies do things like this is because they are allowed to through these "loop holes". Life isn't fair, hell life sucks at times. I've been fortunate to get where I am and I realize that. But you cant continue stacking the deck against the American workers and keep spouting "welp, that's life". Eventually we'll run out of friendly companies that want the outed talent, especially when they realize the $ they "save" by getting it elsewhere.
Anyway we all have our opions, just wanted to clear up the comment I shared and what it meant coming from me. Good luck to you and anyone that was affected.
A "workplace Baltimore"? That is f@cking ignorant. Don't buy into that Marxist "for the workers" BS just because Fossil is doing a sh!tty thing. There are plenty of good jobs in this town. Guess what, kids, life is unfair. But it's unfair in your favor too sometimes and someone else gets screwed when you should have taken the hit. It evens out. The surrounding companies know that Fossil did this and yes, it was unfair, but they are looking to help pick up that talent. Lots of recruiters looking to pick up Fossil people and place them too. Check Craigslist as well. Don't turn this into the nation of "Fair". Learn some history, it doesn't work and all it does it make everything equally bad for everyone but the leaders of the regime. Learn history.
We have been told by management that they should already have knowledge of the systems we use and we just give them the fossil specific things and customizations that were done. We were also told that if we felt they did not have that base knowledge to let management know and then Infosys is on the hook to find someone based on the contract. This has been told to my manager I know 3 or 4 times, yet we keep chugging along showing them things. This is how they are getting through the loop hole of being "required" to hire people with knowledge. Eventually they will "get it" and then no harm no foul for hiring a offshore team with no understanding of our systems. That is why Fossil stands to make $ at the cost of people just leaving (no severence) or getting the same job at a fraction of the cost with offshore (when they get training....I mean "knowledge transfer" done). Until someone files suit or we have a "workplace Baltimore" (taken from previous poster)...the big business wheel will keep running our country...running over American workers as it goes. Cheers.
If anyone knows a lawyer that would take this case, I can see a lot of people joining the lawsuit.
The whole training your replacement thing is such bullsh*t. If you're SO qualified to do our jobs, then shouldn't you ALREADY be trained? #WTF
"According to federal guidelines, the visas are intended for foreigners with advanced science or computer skills to fill discrete positions when American workers with those skills cannot be found. Their use, the guidelines say, should not “adversely affect the wages and working conditions” of Americans. Because of legal loopholes, however, in practice, companies do not have to recruit American workers first or guarantee that Americans will not be displaced."
Not defending this at all, because the entire "Visa" situation is just absolutely crazy, but understandable given the current state of the government. With unemployment a key contributor to so many of our issues here in the US (crime, drugs, economy, etc.) how can our very own government continue with these massive loopholes that benefit the bottom line of our US Corporations (Big Business), but that is so unfair to the workforces...and especially IT.
Trust me, I did spend time at Fossil and have contracted at many other much larger corporations and the situation is the same everywhere I go. It just truly hits home at Fossil given their culture and "American Vintage" focus. Maybe the folks planning to "Train" their replacements at Fossil can get in touch with those doing the same thing at Disney and get something going with a class action suit as suggested.
